There are communities in which disadvantaged groups experience severe inequality. For instance, poor and indigent families face many difficulties accessing their social rights. Their condition is largely the consequence of the wrong choices of those in power, either historical or more recent choices. The lack of opportunities of these deprived citizens is due to state omissions. In such communities, it is not unusual for homeless members of these particular groups to occupy abandoned lands and build their shelters there. However, almost (...) everywhere, these actions constitute a crime. The typical response to this situation is prosecution and punishment. In this paper, I will defend the occupation of public places as a consequence of the failure of governments to solve the problem of housing, and I will argue that we must distinguish a social claim from a crime and avoid the use of criminal law in these “occupation cases”. I will also argue that our right—as a community—to blame and punish these “squatters” is eroded by the fact that we perpetrated their situation of injustice. (shrink)

Carlos S. Nino presentó en sus últimos trabajos una defensa de su teoría del castigo que incluía una profunda crítica al retribucionismo. Según su posición, si adoptáramos una teoría retribucionista del castigo, estaríamos asumiendo una versión del subjetivismo penal que abraza el perfeccionismo moral. Nino presenta esta idea sugiriendo que hay un vínculo estrecho entre el retribucionismo, el subjetivismo y el perfeccionismo. En este trabajo, voy a discutir esa relación y criticar el nexo que Nino cree que existe entre ellos. (...) The late Carlos S. Nino presented in his latest work a defense of his theory of punishment which involves a profound critic to retributivism. According with his position if we adopt a retributivist theory of punishment, in addition we are adopting a version of penal subjectivism that embrace moral perfectionism. Nino presents his idea suggesting that there is a chain that linked retribution subjectivism and perfectionism. This paper questions the notion that states may be justified in denying certain prisoners the right to vote as a means of distancing themselves from particularly grave wrongs. Christopher Bennett has recently defended prisoner disenfranchisement as a fair and deserved retributive punishment for crimes, and Mary Sigler and Andrew Altman have argued in favor of prisoner disenfranchisement as a civil restriction. All three proponents agree that disenfranchisement should be reserved for those guilty of the most serious offenses. I assert that (...) it is inappropriate to treat citizens in this manner and will advocate for the right to vote, whether disenfranchisement is perceived as a form of punishment or as a civil measure. I will present two arguments against disenfranchisement as it impacts both citizens and political community at large. First, it excludes citizens from the democratic arena and restricts the opportunity to reintegrate offenders into the political community. While a criminal sentence is intended to be burdensome, the burden associated with disenfranchisement extends beyond the appropriate penal scope. (shrink)

Para favorecer la interacción disciplinar y recuperar la dimensión práctica del conocimiento matemático en la escuela secundaria, Yves Chevallard plantea la necesidad de introducir en los programas de estudio la matemática mixta. La matemática mixta, cuyo apogeo tuvo lugar en Europa entre los siglos XVI y XVIII, se propone el abordaje de problemas surgidos por fuera de la propia matemática valiéndose de nociones mecánicas -como la de centro de gravedad y fuerza centrífuga- y del empleo de variados instrumentos para realizar (...) las construcciones requeridas. En este trabajo consideramos a la matemática mixta en la cultura matemática de la segunda mitad del siglo XVII y, en dicho contexto, presentamos dos casos de la práctica matemática de G. W. Leibniz en los que la investigación matemática involucra el diseño de máquinas. La consideración de tales casos permite situar a la matemática mixta, siguiendo la terminología de Ian Hacking, en un terreno medio entre representar e intervenir. El terreno medio entre representar e intervenir es un valle fértil donde la matemática aporta a, y se nutre de, una multiplicidad de otros dominios. También es una vía de acceso para historizar el conocimiento matemático, destacando las condiciones materiales para su desarrollo y el importante rol de los problemas. This article provides a comparative and interpretative analysis of the emerging projects in Latin America after the crisis of the neoliberal modernity project. It offers a critical interpretation of the current tendencies in Latin American politics at the national level, while suggesting some hints to understand the current neoliberal crisis in Western countries after Trump’s electoral triumph. The purpose is to figure out the collective meanings behind the new national projects in Latin America (postcolonial indigeneity, confrontational populism, defective neoliberalism, and (...) social liberalism) that are constructing a new regional order. The work examines how the neoliberal modernity project came to be dominant in the late 1980s, only to enter into a period of crisis in the current century. That crisis, in turn, provides the basis for exploring four different alternative projects of modernity, based on the kind of rationality and agency promoted by them. (shrink)

El artículo expone dos visiones acerca de la legitimidad del castigo en contextos de exclusión social. En la primera parte, uno de los autores defiende la idea de que los Estados que incumplen con obligaciones legales previas no pueden inculpar a quienes cometan delitos vinculados con ese incumplimiento. No pueden hacerlo porque no tienen el estatus moral para hacerlo de acuerdo a dos objeciones: la de complicidad y la de hipocresía. En la segunda parte, la segunda autora critica esta solución (...) al sostener que la falta de reciprocidad que caracteriza a la relación política vuelve inaplicables las objeciones de hipocresía y complicidad al ámbito del castigo penal estatal. El liberalismo de Carlos S. Nino evolucionó desde sus primeros trabajos vinculados al derecho penal, hacia la construcción de una teoría de la democracia deliberativa. Desde sus comienzos, siguiendo a los autores liberales clásicos como John Stuart Mill, hasta el final en donde adhirió a un liberalismo igualitario, hubo construcciones que acompañaron este proceso, como el concepto de autonomía personal, y también ciertos ideales morales, como un oposición concreta al perfeccionismo. El texto presenta al liberalismo de Nino al comienzo (...) y al final de su obra para mostrar que el antiperfeccionismo originado en el liberalismo clásico que servía de base para construir su concepción de la autonomía, se mantuvo inalterado durante todo este proceso de evolución dificultando la compatibilización de su teoría de la responsabilidad penal con su teoría de la democracia deliberativa, orientada hacia el liberalismo igualitario. Sugerimos, además, que esa radical ruptura sigue manteniendo elementos vivos y útiles para pensar la política hoy.

This textbook presents the basics of philosophy that are necessary for the student and researcher in science in order to better understand scientific work. The approach is not historical but formative: tools for semantical analysis, ontology of science, epistemology, and scientific ethics are presented in a formal and direct way. The book has two parts: one with the general theory and a second part with application to some problems such as the interpretation of quantum mechanics, the nature of mathematics, and (...) the ontology of spacetime. The book addresses questions such as "What is meaning?", "What is truth?", "What are truth criteria in science?", "What is a theory?", "What is a model?" "What is a datum?", "What is information?", "What does it mean to understand something?", "What is space?", "What is time?", "How are these concepts articulated in science?" "What are values?" "What are the limits of science?", and many more. The philosophical views presented are "scientific" in the sense that they are informed by current science, they are relevant for scientific research, and the method adopted uses the hypothetical-deductive approach that is characteristic of science. The results and conclusions, as any scientific conclusion, are open to revision in the light of future advances. Hence, this philosophical approach opposes to dogmatic philosophy. Supported by end-of-chapter summaries and a list of special symbols used, the material will be of interest for students and researchers in both science and philosophy. Imaginary is, in Taylor's thought, a category of understanding social praxis and the reasons people give to make sense of these practices. The ultimate reason is the hypergood, which influences the strong decisions. Those strong evaluations outline the moral framework from which people address their own lives and the lives of others. We only recognize our cultural framework as an `imaginary' — challenging the supposition it is something `objective' — when others make their apparition in our lives. After the encounter (...) nobody remains the same; something in our imaginary has changed. The outcome of this process is the `best account' we have to make sense of our life. If we accept the category of `imaginary' and the process of `best account' as accurate enough to address Latin American reality, the problem we have to solve is how we can find out a Latin American social imaginary. El trabajo reconstruye y analiza críticamente la respuesta de Jeremy Waldron a importantes problemas sobre política y derecho, justicia y autoridad. Waldron reivindica al mismo tiempo una tesis no escéptica sobre la existencia los derechos morales-políticos, una tesis escéptica sobre la existencia de procedimientos epistémicos superiores para identificarlos, y una tesis positiva sobre la legitimidad política. El trabajo argumenta que su respuesta solo resulta consistente si se añade un cuarto vértice: el presupuesto de “igualdad de agencia y capacidad epistémica” (...) en los portadores de derechos. Pero su introducción requiere abandonar y redefinir dos de los otros elementos, lo que conduce finalmente a las respuestas típicas del deliberativismo epistémico. Las críticas de Waldron a la revisión judicial se reinterpretan sobre esa nueva base. (shrink)

This article enquiries whether normative bioethics can be a science. The article aims to address the conditions of possibility for bioethics to be considered a science, without directly answering the question. The article focuses on two conditions that we typically associate with our common concept of science: truth and knowledge, on the one hand, and naturalization, on the other. Bioethics should be able to provide moral truths and therefore moral knowledge so that we could consider it as a science. On (...) the other hand, the normative character of bioethics raises the question of whether it is possible to naturalize it and make it compatible with a scientific perspective. ¿Why is it that Human Rights must be respected if it seems fashionable the apology for scorning them? This paper intends a review of how is it that Human Rights and the Humanitarian Right have developed, and of why they are not just moral ideals but a universal system of right, not without lacks, but also with plenty of developments. In that order of ideas three devices created to make the Human Rights exigible are analyzed. Such devices are: The incorporation (...) of the International Right in the internal right; the Office of the High Commissioner of United Nations for Human Rights; and the actions that could be accomplished by the States in relations of cooperation with a particular country. In Colombia, since 2003, among the imperfect situation of the International Right, the Human Rights have made the biggest advances to obtain the condition of being exigible. But, despite of such development a lot is still necessary for an acceptable degree of respect of Human Rights in Colombia. Each year a great deal of people die because of political reasons. And, unfortunately, in the last years the Colombian government has promoted legislation very encouraging of war and humanity crimes impunity. Supposedly the government effort is directed to achieve peace and reconciliation among Colombians, but such objective will be reached with great difficulty following such path. The reasons for those difficulties are basically three: Justice Simulation; a preservation of the power of the mobs, and a concealment of the responsibility of the state. But, ¿Does these difficulties mean that there is nothing to be done to find a civilized exit to the Colombian crisis? No. As is pointed out in this article, there are three considerations of logical, historical and political character that allow thinking the following: It is no reasonable to think in dismantling the Social State of Right for preserving the State of right; and a society that deliberately leaves to impunity great crimes of the past can hardly create confidence and guarantee the rights to justice and life for the great crimes of the future. Because of all of this making the Human Rights the minimum common denominator of all political parties, the State and the whole society would be a key to achieve the overcoming of social exclusion in our country and to generate just foundations for a democratic coexistence. Resumen El uso del término imaginación remite a un cierto tipo de actividad mental que en su formulación más básica refiere a la capacidad humana para crear imágenes en ausencia de lo representado, es decir, para representarnos objetos o estados de cosas que están ausentes, y a la capacidad para crear imágenes a partir de otras que ya se poseen. Esta formulación permite dar cuenta de una amplia gama de experiencias humanas que van desde la creación artística y la innovación (...) técnica hasta la anticipación de posibles escenarios en los que intervenir. En particular voy a centrarme en un uso específico de la imaginación que denominaré imaginación práctica y que consiste principalmente en la anticipación contrafáctica de posibles estados de cosas resultantes de nuestras acciones. A partir de esto sostendré la existencia de una relación interna entre imaginación práctica y racionalidad práctica, en virtud de la cual la primera oficia de posibilitadora de la segunda. Para ello relevaré cuatro formas de ejercicio de la racionalidad práctica que han sido tematizadas a lo largo de la historia de la filosofía: la ética, la moral, la política y la legal.The use of the term imagination refers to a certain type of mental activity that in its most basic formulation refers to the human capacity to create images in the absence of what is represented, that is, to represent objects or states of things that are absent, and the ability to create images from others that are already possessed by the agent. This formulation allows to account for a wide range of human experiences ranging from artistic creation and technical innovation to the anticipation of possible scenarios in which to intervene. In particular, I will focus on a specific use of the imagination that I will call practical imagination and that consists mainly in the counterfactual anticipation of possible states of affairs resulting from our actions. From this perspective I will sustain the existence of an internal relation between practical imagination and practical rationality, by virtue of which the first enables the second. To do this, I will highlight four types of practical rationality that have been thematized throughout the history of philosophy: ethical, moral, political and legal rationality. (shrink)

ABSTRACT In the 1960s, when Dr. Belding Scribner discovered how to accomplish the process of dialysis in a repeated way, he could not imagine that in solving such a problem others as or more difficult would appear. Given the technological progress and the impossibility of assisting all patients through the most modern methods, the medical doctor often finds himself faced with the moral dilemma of choosing which patient in the waiting list will receive the treatment. This same dilemma is amplified (...) in the case of organ transplants. Professionals, students, professors of the juridical and health fields, and the population in general, were interviewed as a means of documenting the moral concepts and opinions surrounding this problem. In the reality in which we find ourselves, it seems to us that deciding who lives, and the responsibility for all the events that culminate in such decisions, is still a subject left open to discussion. The problem of the applicability of moral principles is one of the most significant issues of practical reflection. With Kant's practical philosophy, the ethical demands of universality and individuality came to seem incompatible. After reviewing the outlooks of Apel and Simmel, who both offer paradigmatic answers to the “rigorism” of the categorical imperative, this article presents the issue from the perspective of Maliandi's “Convergent Ethics”. It suggests that Maliandi's recognition of an “a priori of conflictivity” and of the bi-dimensional character (...) of reason surmounts the shortages of both Apel's and Simmel's philosophies. This papers analyzes the communitarian project of social integration exposed in the Walzer and Etzioni's work as a possible answer to the disintegration of social bonds in the advanced societies . It deals with the notions of tolerance, solidarity and moral resocialization of the citizenship. Investigadores pertenecientes a la tradición de la psicología del desarrollo cognitivo han llevado a cabo estudios que sugieren que existe un vínculo entre la percepción de daño y el dominio moral. Frente a esta propuesta unificadora del dominio moral han surgido críticas desde la psicología cultural. Haidt publicó en 1993 uno de los estudios más influyentes en esta línea, afirmando haber encontrado evidencia que sugiere la existencia de dominios morales no vinculados a la noción de daño. En este artículo (...) se hará una presentación general del debate en torno al contenido del dominio moral. Luego presentaremos y evaluaremos el estudio de Haidt et al.. Por último, presentamos resultados experimentales que cuestionan las conclusiones de ese estudio y sugieren que el debate sigue abierto. Researchers belonging to the tradition of cognitive-developmental psychology have suggested studies that the perception of harm is central to the Moral Domain. This unifying proposal of the Moral Domain has provoked the criticisms of researchers working in Cultural Psychology. Haidt published in 1993 a very influential study, claiming to have found evidence for the existence of Moral Domains not linked to the notion of harm. In this paper, we briefly present the debate around the content of the moral domain. We then critically examine the study by Haidt et al.. Finally, we present experimental results that question the conclusions of their study and suggest that the debate is still open. (shrink)

In this article, we discuss the question about how the practices of deceiving become a matter of discussion on moral philosophy and how they could be thought beyond the sieve of this conviction. As we intend to defend, an answer to this question should refer to the Greek thought, particularly, the Platonic thought in dialogues: Hippias minor and The republic, taking as horizon the problem of the disambiguation of Alêtheia, and the exclusion, by philosophical thought, of the forms of clever (...) and astute intelligence that the Greeks named in honor to the goddess Mêntis. On the other hand, should also imply a distinction of perspectives inherent to what we call by deceiving, which put on opposite sides of the deceiver and the deceived, according to the acknowledgement, or not, of the deceiving. Under this bias, we argue that, for the Greeks, the problem wouldn't be mainly the mistake itself – although platonic thought points that – but being deceived, and mainly, self-deceived. (shrink)

Seria possível pensar a liberdade a partir da crítica radical ao livre-arbítrio e à moral feita pelo filósofo? Para isto, partiremos da caracterização da vontade de potência, entendida como expressão imediata de força e sempre em direção ao crescimento, para depois pensá-la em relação às ações humanas, entendendo que essas obedecem à mesma lógica. Por fim, a questão da liberdade será entendida enquanto proposta de (...) fortalecimento e engrandecimento de si a partir de sua própria vontade e não de algum valor moral ou regra social.: In the present paper we propose to think about the issue of freedom in Nietzsche's philosophy. We want to know if is it possible to talk about freedom in Nietzsche´s thinking, once he has made a radical critique of free will and moral? For this proposal, we will start from the characterization of the will to power, understood as an immediate expression of strength and always towards growth, and then think about it in relation to human actions, understanding that they obey the same logic. Resumen En el § 7 de la Crítica de la razón práctica Kant expone su primera definición de la ley moral universal. Ahí afirma que la conciencia de ella es un “Faktum de la razón”. La ambigüedad de esta expresión ha hecho que algunos autores argumenten que Kant no deduce la ley moral satisfactoriamente ni aclara cómo llegamos a ser conscientes de ella. Sin embargo estos críticos olvidan en sus análisis un aspecto relevante de la filosofía moral kantiana y que (...) es de gran relevancia en los estudios contemporáneos de la filosofía de la acción: el carácter autoconstitutivo del yo o del sujeto racional y su papel en la fundamentación de la moralidad. Sostengo que el Faktum de la razón debe entenderse fundamentalmente como un acto autoconstitutivo.In § 7 of the Critique of Practical Reason Kant presents his first definition of the universal law of morality - called the Categorical Imperative. In the same place, he affirms that being conscious of the law of morality is a Faktum of reason. The ambiguity of this statement has prompted some authors to argue that Kant does not deduce the moral law satisfactorily nor does he clarify how we become conscious of it. Nevertheless, they all forget in their analysis a relevant aspect of Kantian moral philosophy that turns out to be of great importance in contemporary studies of the philosophy of action - the self-constituting character of the rational subject and the role it plays within the foundation of morality. I claim that the Faktum of reason must be understood fundamentally as a self-constituting act. (shrink)

“Democratic Ethical Life and the Struggle for Recognition: AReconstruction of Hegel’s Inluence on Deliberative Democracy”. Hegel’s politicalphilosophy represents a signiicant contribution to the understanding of moderndemocracy and social dynamics. As regards modern democracy, the concept ofdemocratic ethical life presented by Wellmer allows for the integration of equalsubjective rights and citizen participation in a deliberative culture that illsdemocracy with citizen vitality without going against individual liberties. As forsocial dynamics, they can be explained by the need for reciprocal recognition asthe key to (...) the constitution of subjectivity, which explains the moral motivation inthe struggles of social groups. Both concepts are closely interwoven because thestruggle for recognition allows for an explanation of the dynamics of democraticethical life. Thus, democratic ethical life and the struggle for recognition, asinterwoven concepts, offer two key notions for the solution of some of the obstacleswith which contemporary political philosophy must deal. El reconocimiento, en tanto que constitutivo de la subjetividad, es una necesidad básica tanto de las personas como de los Estados. Los términos de relación internacional impuestos por buena parte de los organismos internacionales de crédito y comercio niegan y socavan este reconocimiento a través de políticas que generan exclusión y pobreza en los países más pobres. La ruptura de esta lógica se presenta como un camino que posibilita el surgimiento de condiciones de justicia global basadas en términos de reconocimiento (...) recíproco. Un argumento prudencial oficia como primer paso en este proceso, el beneficio a medio y largo plazo sería la motivación racional para que los organismos internacionales generasen una apertura que permitiese asegurar el reconocimiento recíproco. Sin embargo, este argumento no es suficiente y el objetivo de una inclusión radical que afecte a todas las regiones del planeta requiere un argumento moral basado en la idea de igual dignidad inherente a toda persona. La justicia global y su contraparte de justicia local solamente serán posibles a través de una conjunción de estos dos argumentos que habilitarían la instalación de una lógica de reconocimiento recíproco como posibilitante de la justicia. This article aims to investigate the assumptions that lead to a conviction by moral philosophy of the various practices of deceit commonly involved under the name of hypocrisy. The argument is developed around three questions: first, on the assumptions under which the various practices and strategies of deceit – such as: simulation, dissimulation and irony – become a problem to moral philosophy. Secondly, in order to understand how the hypocrisy, originally assigned to the art of the actor, comes to be (...) part of the moral sphere designating, as art of deception, the set of those morally reprehensible strategies. Finally, how could be set a way opposed to this conviction. As I argue, that would happen with a double presumption: a distinction of perspectives between deceiving and being deceived– with their respective modes of evaluation – and through a re-evaluation of thought forms linked to astute intelligence that the Greeks called metis. Under these assumptions, hypocrisy could be linked to the ethical-poietical agenda of the creation of self. (shrink)

This article deals with Nietzsche’s ethical problem of the constitution of an exceptional character, under two fronts: first, under a negative bias, as opposed to the morality of the herd. Later, on its constructive or affirmative time, properly as creation of self . The leitmotif of this double presentation is the defense of aspects from what we associate with the concept of hypocrisy as a key to an interpretation of that constitution. First, as an art of dissimulation, in the form (...) of an individual's refuge amidst the morality of the herd. ABSTRACT In the 1960s, when Dr. Belding Scribner discovered how to accomplish the process of dialysis in a repeated way, he could not imagine that in solving such a problem others as or more difficult would appear. Given the technological progress and the impossibility of assisting all patients through the most modern methods, the medical doctor often finds himself faced with the moral dilemma of choosing which patient in the waiting list will receive the treatment. This same dilemma is amplified (...) in the case of organ transplants. Professionals, students, professors of the juridical and health fields, and the population in general, were interviewed as a means of documenting the moral concepts and opinions surrounding this problem. In the reality in which we find ourselves, it seems to us that deciding who lives, and the responsibility for all the events that culminate in such decisions, is still a subject left open to discussion. This article investigates if and how negotiators' self-efficacy beliefs affect their use of deception in negotiation. Specifically, we propose that self-efficacy can be interpreted as a threat to self-concept, which encourages individuals to temporarily bypass self-regulatory obstacles by morally disengaging their cognitive moral filters, thereby enabling them to use deception in negotiation. We test our hypotheses in three independent experimental studies involving an interactive negotiation simulation, totalizing 460 participants. We find that negotiators with low self-efficacy regarding their negotiation abilities are (...) more likely to use deception than those with high self-efficacy beliefs. Furthermore, we find that moral disengagement mediates the effects of self-efficacy on deception. Our findings suggest that self-efficacy plays a key role in shaping negotiators' ethical behaviors and we identify the psychological mechanism underlying this relationship. (shrink)

He is also a pioneer in discussions of moral realism, and has made important contributions to bioethics, the philosophy of human rights and moral responsibility. Argumento específicamente en contra de una estipulación según la cual “ética” se refiere a la afirmación de la conciencia individual autónoma o auténtica, mientras que “moral”, a la esfera de la observancia de reglas impuestas por la sociedad. Si el propósito de la estipulación es mostrar la mayor (...) importancia relativa de la primera sobre la segunda, por sí sola, esta distinción no nos da ninguna justificación de por qué la conducta ética es superior a la moral. This article aims at raising awareness about the intersection of populism and bioethics. It argues that illiberal forms of populism may have negative consequences on the evolution of bioethics as a discipline and on its practical objectives. It identifies at least seven potential negative effects: (1) The rise of populist leaders fosters “epistemological populism,” devaluing the expert and scientific perspectives on which bioethics is usually based, potentially steering policies away from evidence-based foundations. (2) The impact of “moral populism” is evident (...) in legislative prioritization of the “morality of common people,” often solicited through popular consultations on issues like abortion, drug legalization, or LGBT issues. (3) Populist distrust in autonomous governmental agencies and advisory bodies, including national bioethics commissions, can compromise expert advice, challenging both their authority and decisions. (4) Populists may erode transparency by undermining institutions responsible for it, hindering access to vital information for bioethical research. (5) “Medical populism” creates adversarial dynamics, prompting politicians to make simplistic healthcare policy decisions based on political rather than informed criteria, adversely affecting vulnerable populations. (6) Radical-right populist parties’ “welfare chauvinism” may shape healthcare policies, impacting service access and resource allocation, disproportionately affecting vulnerable groups such as migrants, but indirectly affecting the rest of the population. (7) Nationalist sentiments associated with populism may obstruct international collaborations, posing challenges for global bioethics that seeks to address ethical concerns beyond national borders. In summary, these dynamics raise significant bioethical concerns encompassing evidence-based decision-making, transparency, healthcare equity, and global collaboration. The 2016 Royal Society of Chemistry’s report Future of the Chemical Sciences presents four different scenarios for the future of chemistry: chemistry saves the world; push-button chemistry; a world without chemists; and free market chemistry. In this paper we ethically assess them. If chemistry is to solve many of the greatest challenges facing the contemporary world, prioritization of research topics will need to be done explicitly on the basis of moral values, ​​such as solidarity and equity, but also environmental justice, (...) which will have to be central in determining a research agenda for chemistry. The decentralization of chemistry will also present ethical challenges to the research standards established by the scientific community. Ethical education in chemistry may help counteract these risks. We also argue that if chemistry and its subdisciplines are to fulfil their goal of generating knowledge and helping us solve the great challenges of the contemporary world, then it is ethically imperative that scientists from different disciplines be more open to interdisciplinary work. Finally, if the future of chemistry is in free market forms, then it is necessary that we pay more attention to the possible risks that this model has. We call attention to two: first, it is likely that problems that affect the lowest income countries or the most disadvantaged sectors of society, who do not have the means to pay for some of the goods and services, will not be addressed; second, the free market tends to foster unsustainable forms of development. En este artículo analizo los principales argumentos del libro Tauroética de Fernando Savater. Él afirma que existen argumentos morales a favor de las corridas de toros, por lo que ser taurino es una opción ética legítima. Aquí sostengo que está en un error y que los argumentos morales no tienen la fuerza que él les adjudica; puede haber razones económicas, políticas o de otro tipo a favor de las corridas, pero no hay razones morales. Afirmo, en cambio, (...) que sí hay razones morales fuertes en contra de las corridas que se basan en que los toros son objeto de consideración moral, es decir, tienen un estatus moral independiente de nuestros intereses. A partir de esta premisa examino y objeto, bajo una perspectiva ética, otros argumentos de Savater. (shrink)

Tienen razón Francisco Lara y Olga Campos en afirmar en la introducción de su libro que “un mérito importante de este libro es que, de manera muy divulgativa, pretende dar respuestas filosóficas al debate sobre nuestra relación con los animales al aplicar ideas bási- cas a cuestiones prácticas como si debemos ser o no vegetarianos, si hay que experimentar con animales o hasta qué punto son justifica- bles las corridas de toros” (p. 15). Y efectivamente, de una manera muy clara, (...) el libro no sólo pretende, sino que en efecto da respuestas a cuestiones centrales sobre nuestra relación con los animales, en particular a la cuestión acerca de cuál es su estatus o su valor moral y, por ende, sobre si tenemos obligaciones morales hacia ellos. Su tesis es que los animales sí tienen un estatus moral independiente de los intereses humanos, que tienen derechos y que es nuestra obligación moral respetarlos. Parte de ese respeto consiste en no tratarlos como meros instrumentos o recursos al servicio de los inte- reses de los humanos. (shrink)

El esteticismo y el moralismo son dos vicios de desmesura en los que se sobredimensionan los valores estéticos o morales en situaciones en las que están en juego otros valores que también deberían tomarse en cuenta, pero se subvaloran. Carlos Pereda sostiene que son patologías del juicio y argumenta que la literatura ha sido víctima de distintas variantes de estos vicios. Para ello, distingue entre diferentes formas de esteticismo y de moralismo, y analiza cómo algunas de ellas tienen implicaciones (...) a nivel semántico y de comunicación. Pereda propone un “modelo reflexivo” que contrarrestre el vértigo simplificador que representan estas patologías. En esta nota, examino críticamente la teoría de Pereda y propongo otros modos que puede tomar el análisis del esteticismo y del moralismo. (shrink)

En el debate entre el positivismo y el no-positivismo el argumento del relativismo tiene un papel fundamental. Tal y como es presentado, por ejemplo, por Hans Kelsen, este argumento señala, en primer lugar, que una conexión necesaria entre el derecho y la moral presupone la existencia de elementos morales objetivos, absolutos y necesarios, y, en segundo lugar, que estos elementos morales objetivos, absolutos y necesarios no existen. Mi respuesta a esto es que los elementos morales absolutos, objetivos (...) y necesarios existen, porque los derechos humanos existen, y éstos existen porque son fundamentables. In the debate between positivism and non-positivism the argument from relativism plays a pivotal role. The argument from relativism, as put forward, for instance, by Hans Kelsen, says, first, that a necessary connection between law and morality presupposes the existence of absolute, objective, or necessary moral elements, and, second, that no such absolute, objective, or necessary moral elements exist. My reply to this is that absolute, objective, or necessary moral elements do exist, for human rights exist, and human rights exist because they are justifiable. (shrink)

ABSTRACT The presence of truth and honesty is a permanent demand, and becomes vital the more committed and intimate a relationship is. Medical practice is relevant to this discussion when one questions whether or not a physician should always tell their patient the truth in the face of a progressive or potentially fatal disease, regarding the diagnosis, outcome, therapy and evolution of the specific disease. From this discussion we aim, with the present report, to look at the truth applicable to (...) the patient‐physician relationship, and its ethical and moral implications; and also to look at where the Brazilian Code of Medical Ethics (BCME) and the medical literature stand regarding this issue. One concludes that there are only two moments not to tell a patient the truth: when the patient does not want to be informed, and when the truth could be iatrogenic. The question now is, when would the truth be iatrogenic? Physicians, in our opinion, would not be able to judge solitarily when the truth might be deleterious to their patient. Alternatively, we propose the appointment of a multidisciplinary commission to help the doctor with such a decision. (shrink)

Dung’s argumentation frameworks are formalisms widely used to model interaction among arguments. Although their study has been profusely developed in the field of Artificial Intelligence, it is not common to see its treatment among those less connected to computer science within the logical-philosophical community. In this paper we propose to bring to that audience a proof-theory for argument justification based on tableaux, very similar to those the Logic students are familiar with. The tableaux enable to calculate whether an argument or (...) subset of arguments are accepted or rejected in accordance to Dung’s preferred and grounded extension-based semantics. Soundness and completeness results regarding those semantics are provided. (shrink)

The problems that arise from the presence of self-attacking ar- guments and odd-length cycles of attack within argumentation frameworks are widely recognized in the literature on defeasible argumentation. This paper introduces two simple semantics to capture different intuitions about what kinds of arguments should become justified in such scenarios. These semantics are modeled upon two extensions of argumentation frameworks, which we call sustainable and tolerant. Each one is constructed on the common ground of the powerful concept of admissibility introduced by (...) Dung in [10]. The novelty of this approach consists in viewing the admissibility of a subset of arguments as relative to potentially challenging subsets of arguments. Both sustainable and tolerant semantics are more credulous than preferred semantics (i.e. they justify at least the same arguments, and possibly more). Given certain sufficient conditions they coincide among them as well as with other semantics introduced by Dung. (shrink)

Traditionally, in Spain bullfighting represents an ancient and well-respected tradition and a combined brand of sport, art and national identity. However, bullfighting has received considerable criticism from various segments of society, with the concomitant rise of the animal rights movement. The paper reports a survey of the Spanish citizens using a face-to-face survey during January 2016 with a total sample of 2522 citizens. The survey asked about degree of liking and approving; culture, art and national identity; socio-economic aspects; emotional perception (...) and animal welfare. The hypothesis proposed that the perception of bullfights may be affected by gender, age, occupation, origin and nationality of the persons surveyed. The hypothesis was confirmed. The majority of citizens surveyed do not like bullfights and great majorities do not attend or watch such events. Two extreme clusters were described: one representing favorable attitude towards bullfighting and other against bullfighting. The proportion of indifferent persons was important. Women and young people showed a more favorable attitude towards animal welfare issues associated with these events. Rural people were more accepting bullfights than urban people. Students were more anti-bullfight than those in other occupations. Additionally, technical economic factors made people favor more bullfights. The growth of claim against bullfights establishes an element of a far more multifaceted phenomenon that animal cruelty per se and support of a new paradigm called social change in countries as Spain. We reported a series of experiments carried out to confront the underlying intuitions of value-based argumentation frameworks (VAFs) with the intuitions of ordinary people. Our goal was twofold. On the one hand, we intended to test VAF as a descriptive theory of human argument evaluations. On the other, we aimed to gain new insights from empirical data that could serve to improve VAF as a normative model. The experiments showed that people’s acceptance of arguments deviates from VAF’s semantics and is (...) rather correlated with the importance given to the promoted values, independently of the perceptions of argument interactions through attacks and defeats. Furthermore, arguments were often perceived as promoting more than one value with different relative strengths. Individuals’ analyses of scenarios were also affected by external factors such as biases and arguments not explicit in the framework. Finally, we confirmed that objective acceptance, that is, the acceptance of arguments under any order of the values, was not a frequent behavior. Instead, participants tended to accept only the arguments that promoted the values they subscribe. (shrink)

In this paper we present an embedding of abstract argumentation systems into the framework of Barwise and Seligmans logic of information flow. We show that, taking P.M. Dungs characterization of argument systems, a local logic over states of a deliberation may be constructed. In this structure, the key feature of non-monotonicity of commonsense reasoning obtains as the transition from one local logic to another, due to a change in certain background conditions. Each of Dungs extensions of argument systems leads to (...) a corresponding ordering of background conditions. The relations among extensions becomes a relation among partial orderings of background conditions. This introduces a conceptual innovation in Barwise and Seligmans representation of commonsense reasoning. (shrink)

El contenido del libro lo integran trabajos presentados por algunos de los más importantes filósofos anglosajones del derecho penal, todos ellos profesores en aquel momento en el Reino Unido. Dichos trabajos fueron discutidos por penalistas, filósofos y criminólogos de habla hispana provenientes de España, Argentina y Chile. En este sentido, el workshop ejemplificó también el tipo de acercamiento que los distintos mundos académicos, en este caso el mundo anglosajón y el hispano, o de forma más general el mundo jurídico del (...) common law y el de la tradición europea continental, están viviendo en estos días.
